Illegal constructions destroying top fertile soil, environmentalist sends notice to Gr Noida authorities

New Delhi: Massive mining of top fertile soil is taking place and villagers are being coverted into slums in a large area of Greater Noida as builders, many of them land mafias, are illegally plotting and constructing flats and apartments.

These builders neither have registration with TERA, nor have any building/layout plans sanctioned from the Greater Noida Authority, says environmentalist and public interest alwyer Akash Vashishtha, who has sent a notice to Chairperson, RERA, CEO, Greater Noida Industrial Development Authority, and DM and Commissioner of Police of  Gautam Budh Nagar district of Uttar Pradesh urgimg them to take action.

In his notice, he has said that these flats were being sold to gullible people in and around Sadullapur, Accheja, Roja Jalalpur, Khairpur, Vaidpura, Sunpura and Kheri-Bhanauta villages of Greater Noida.

These activities violate Sections 3, 9, 11, 12, 13, 14 & 15 of the Real Estate (Regulation and Development) Act, 2016, and they are also is violative of Section 9 of the U. P. Industrial Area Development Act, 1976, defeating the very purposes of an effective and planned development of the Notified Area of Greater Noida Authority.

They also violate Section 80 of the Uttar Pradesh Revenue Code, 2006 and  contravene provisions of the Environment (Protection) Act, 1986, Water(Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981, as none of these builders have Environment Clearances, Consents to Establish & Operate.

Besides, the excessive, perpetual illegal mining of fertile top-soil in the adjoining areas is resulting in social, cultural and economic exploitation of the village inhabitants.

”All this has taken place because of an active collusion of your officials and these builders/land grabbers. As a native of Sadullapur, I am pained to see my glorious village turning into a Slum,” Vashishtha said in his notice.

He urged the authorities to immediately conduct crackdown on all these builders/land mafia, demolish all the illegal structures, so raised, register FIRs and arrest all those concerned.

”If no action is taken within 15 days, I shall be compelled to raise the matter before appropriate Judicial fora’,’ he said.
