The Supreme Court on Tuesday granted interim relief to expel BJP Spokesperson Nupur Sharma and directed that no coercive action be taken against her in the FIRs/Complaints registered over her remarks on Prophet Mohammed or on FIRs/Complaints which may be registered in the future.
The bench of Justice Suryakant and Justice JB Padriwala was hearing Nupur Sharma’s plea to revive her withdrawn writ petition which was filed to club the multiple FIRs registered in different states. it is to be noted that Nupur Sharma had withdrawn her petition on July 1 following the critical remarks by the same vacation bench against her public comments. The same bench considered her application to re-open the case.
Pronouncing the order in the case, the SC said, “In the light of the subsequent events, some of which have been noticed above, the concern of this court is how to ensure that the petitioner can avail the alternative remedy as permitted by this Court on July 1. To explore this, let notice be issued to the respondent’s returnable by 10th August. Copies of the main writ petition are also forwarded along with the notice. Liberty is granted for dasti and service through standing counsels. Meanwhile, as an interim measure, it is directed that no coercive action shall be taken against the petitioner according to the impugned FIRs or such FIRs/complaints which may be registered/entertained in the future about the same telecast dated 26.05.2022.” The Live Law reported
