SC hears petition challenging process of designation of senior advocates

New Delhi: The Supreme Court has heard a petition filed by Ms. Fozia Rahman Advocate and Ms. Sunieta Ojha, AOR which raises issues of transparency, objectivity and fairness in the process of senior designation of advocates by the punjab and haryana high court. The petitioner, Satish Chaudhary yesterday challenged the non-inclusion of his name in the list of advocates designated as Senior Advocates by the Punjab and Haryana High Court.

The grievance of the petitioner arises from the point-based evaluation process adopted for senior designation. It is the petitioner’s case that despite securing higher marks, his name was not placed before the Full Court for consideration, while certain advocates who had secured lower marks were ultimately designated as Senior Advocates, without considering that the fact that the Petitioner belongs to marginalised community and is a first generation advocate.

Counsel for the petitioner, Ms. Sunieta Ojha and Ms. Fozia Rahman, assisted by Ms. Pragti Bhatia and Vasudha Priyansha, submitted that the manner in which the process was carried out was not in conformity with the principles laid down by the Supreme Court in Indira Jaising judgements. It is not only the peritioner’s grievance but also that a number of advocates are aggrieved by the manner in which the process has been carried out.

A Bench of Justice Dipankar Datta and Justice Satish Chandra Sharma hear the matter and posted it for hearing next week for consideration, the lawyers for the petitioner said.
